TERMS AND CONDITIONS – MARKETING AUDIT REPORT (MAR)

1. Nature of the Product

1.1 The Marketing Audit Report (“MAR”) is a custom digital service that analyses a client’s online visibility, listings, reviews, SEO, and marketing performance.
1.2 Each report is individually prepared for the purchasing client based on publicly available information and any data the client provides.
1.3 Because this is a customised digital service, refunds will not be issued once report generation has commenced.


2. Delivery and Timelines

2.1 Reports are delivered digitally in PDF format via email.
2.2 The estimated turnaround time is 5–7 business days from payment confirmation.
2.3 During high-demand periods, delivery times may extend beyond the estimated timeframe. All timelines are estimates and not guarantees.
2.4 Clients will be notified of any substantial delays and may request updates via email or the QCMD chatbot.


 3. Payment Terms

3.1 All purchases are payable upfront via Stripe before work commences.
3.2 Payment confirms acceptance of these Terms and Conditions.
3.3 Refunds are only available if no report work has started and the cancellation request is received within 48 hours of purchase.
3.4 Discounted or promotional purchases, including Black Friday offers, are final and non-refundable.
3.5 No work will begin until full payment has been received and confirmed.


4. Data Access and Privacy

4.1 By purchasing the MAR, the client authorises QCMD Marketing to access and analyse data from public digital sources such as Google, Facebook, and online business directories.
4.2 QCMD Marketing complies with the Protection of Personal Information Act (POPIA) and treats all collected data with confidentiality.
4.3 Information provided by the client will only be used for creating and delivering the MAR report and associated support services.
4.4 QCMD Marketing may store anonymised and aggregated data from MAR reports for internal analytics, benchmarking, and product improvement.
4.5 Client information will never be sold or shared with unauthorised third parties.


5 Accuracy and Limitations of the Report

5.1 All data in the MAR is accurate at the time of generation.
5.2 The report reflects current online visibility and performance metrics, which may change over time due to updates by Google, listings platforms, or third parties.
5.3 The report is intended for informational and advisory purposes only and does not guarantee specific business outcomes such as ranking improvements, revenue increases, or customer acquisition.
5.4 QCMD Marketing will not be liable for any loss, damages, or claims arising from the use, interpretation, or implementation of the report’s recommendations.
5.5 Clients are responsible for reviewing and acting on recommendations at their discretion.


5. Support and Communication

6.1 Clients may request support after receiving the report via email, WhatsApp, or the QCMD all-in-one chatbot.
6.2 Support is provided upon request and may include one complimentary 15-minute consultation session, subject to booking availability.
6.3 Additional strategy sessions or implementation assistance are available at standard consulting rates.
6.4 All communication must be respectful and professional; abusive language or behaviour will result in termination of support privileges.


7. Intellectual Property and Use Rights

7.1 The MAR report format, design, structure, and underlying methodology remain the intellectual property of QCMD Marketing.
7.2 Clients are granted permission to use their report for internal business purposes only, including sharing among staff, partners, and directors.
7.3 Clients may not reproduce, resell, or publicly distribute the report, either in part or in full, without written consent from QCMD Marketing.
7.4 QCMD Marketing retains all proprietary rights to its templates, graphics, systems, and audit processes.


8. Refunds, Cancellations, and Cooling-Off Period

8.1 The MAR is a custom service, and once work has commenced, it is non-refundable.
8.2 Under South African law, online purchases normally include a 7-day cooling-off period. However, this right does not apply to custom digital work once it has started.
8.3 If a client cancels before work begins and within the 48-hour window, a full refund will be processed within 7 business days.
8.4 No partial refunds or credit notes will be issued after report delivery.


9. Marketing Permissions

9.1 QCMD Marketing may use anonymised MAR data (without revealing business names or details) to demonstrate average performance trends or marketing success rates.
9.2 Clients who purchase the report agree that anonymised results or visual screenshots may be referenced for marketing or educational purposes.
9.3 Clients may opt in to receive future product updates, promotional offers, or insights by agreeing to marketing contact at checkout.


10. Liability and Indemnity

10.1 The client acknowledges that all business and marketing outcomes depend on external factors beyond QCMD Marketing’s control, including market behaviour, competition, and algorithmic changes.
10.2 QCMD Marketing shall not be liable for any indirect, incidental, or consequential damages, including lost profits, loss of data, or business interruption.
10.3 The client agrees to indemnify QCMD Marketing and its staff from any claims, liabilities, or damages arising from the use or misuse of the report or recommendations.


11. Jurisdiction and Governing Law

11.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.
11.2 Any disputes or claims will be handled under the jurisdiction of the High Court of South Africa, Western Cape Division (Cape Town).
11.3 The parties agree to first attempt resolution through good-faith negotiation before escalating to formal legal proceedings.


12. Amendments

12.1 QCMD Marketing reserves the right to update or amend these Terms at any time.
12.2 Changes will be posted on the official website and apply to future purchases after publication.
12.3 The version of the Terms effective at the date of purchase shall govern that transaction.
